REBUTTAL TO SENATOR LUGAR'S LETTER

Dear Senator Lugar:

Thank you for taking the time to answer my letter of 4 March 2004 in which I expressed my concern for your resurrection of the “Law of the Sea Treaty”.

Your six statements of arguments justifying your actions concerning the treaty were well selected and well stated. It is my contention that a single provision of the LOST rebuts and negates each point of your entire argument. Let me quote that provision here:

Part II, Section 1, Article 2 (3) states: “The sovereignty over the territorial sea is exercised subject to this Convention and to other rules of international law.”

Acceptance of the “United Nations Convention of the Law of the Sea” cedes the United States sovereignty of its coastal waters and its free passage of the oceans to the United Nations.

May I ask that you revisit the oath you spoke upon accepting your office as Senator from Indiana.
